Escrow Services Agreement

By accepting this Agreement, you enter into a direct contractual relationship with Escrow Africa for escrow facilitation services provided through the Platform.

This Agreement supplements the Escrow Africa Terms and Conditions. If there is any inconsistency regarding escrow services, this Agreement prevails.

Each time you create or join a transaction on the Platform, you must confirm that this Agreement applies to that transaction before the transaction may activate.

Escrow Africa will not activate a transaction unless all transacting users have confirmed the current version of this Agreement for that transaction.

If a transaction is cancelled before completion, Escrow Africa will facilitate the refund of undisbursed escrowed funds only after verifying that the cancellation complies with the Terms and Conditions, the uploaded agreement between the parties, and this Agreement.

You consent to Escrow Africa's administrative resolution of disputes where the amount in dispute is below GHS 5,000, in accordance with the Terms and Conditions as amended from time to time.

You consent to escalation of disputes of GHS 5,000 and above to the Ghana Arbitration Centre, in accordance with the Terms and Conditions as amended from time to time.

This consent is a condition of using escrow services and enables Escrow Africa to process releases in accordance with validated dispute outcomes.

Records of your acceptance of this Agreement (including version, timestamp, and method) constitute personal data processed in accordance with the Data Protection Act, 2012 (Act 843) and our Data Protection Policy.

Escrow Africa may amend this Agreement. The current version is published on the Platform. If the Agreement has changed since your last acceptance, you must accept the current version before your next transaction.
